THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26835 of 2018 ORDER:

The grievance of the petitioner in the present Writ Petition is the inaction on the part of the 6th respondent in issuing the No Objection Certificate on the application, dated 05.05.2014, for grant of quarry lease in respect of an extent of 12.000 Hects., in Sy.No.33 of Murikipudi village, Chilakaluripeta Mandal, Guntur District.

Vide letter bearing No.2935/Q /14, dated 05.05.2014, on receipt of the quarry application submitted by the petitioner herein, one set of application was forwarded to the Tahsildar, Chilakaluripet Mandal, Guntur District, by the Assistant Director of Mines & Geology, Guntur, for issuance of classification and availability and No Objection Certificate in respect of the above said area.

Since the matter is pending since 05.05.2014 before the Tahsildar, Chilakaluripet Mandal, Guntur District, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the 6th respondent to respond to the letter bearing No.2935/Q/14, dated 05.05.2014 of the Assistant Director of Mines & Geology and to submit a report, as expeditiously as possible, strictly in accordance with law, preferably within a period of six weeks from the date of receipt of a copy of this order. Pending consideration the submission of the report by the Tahsildar/6th respondent, as indicated supra, there shall be status quo as on today with regard to the application submitted by the petitioner before the Mines and Geology Department.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
