This Petition coming on for hearing,upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri PULIMAMIDI SHASHIDHAR REDDY, Advocate for the Petitioners and of the Assistant Public Prosecutor on behalf of the Respondent No.

THE HON'BLE DT. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.893t of 2Cr22 ORDER:

Heard the submission of learned counsel for the petitioner as well as learned Assistant public prosecutor, who is representing respondent No. l-State. Having regard to the limited request made by Iearned counser for the petitioners, issuance ol notice to rbspondent No.2/defacto complainant is felt not necessary.

This Criminal petition is filed seeking the Court to quash the proceedings that are pending against the petitioners, who are arrayed as accused Nos.2 and 3 in C.C.No.2685 of 2O21 on the file of the Court of V Additional Judicial Magistrate of First Class, Waranga-l. 3.

Learned counsel for the petitioners states that petitioner No.2 is the mother_in_law and petitioner No.3 is the father-in-law of the respondent No.2 and they never involved in the family affairs of the accused No.1 and his wife that is respondent No.2 herein. Learned counsel also

Dr. CSL,J Crl.P.No.89ll of2022 submits that the petitioner Nos.2 and 3, being aged persons, are unable to attend the Court on each and every \ date ol adjournment. Learned counsel finally states that no further orders in this Criminal Petition are required, except dispensing with the personal attendance of petitioner Nos.2 and 3 before the trial Court.

Learned Assistant Public Prosecutor did not raise any serious objection. Also the relief sought for appearance justifiable.

Therefore, this Criminat Petition is diSposed of with the following directions:

(1) The Court of V Additional Judicial Magistrate of First Class, Warangal, is directed not to insist upon personAl attendance of the petitioners during the course of proceedings in C.C.No.2685 of 2027 that is pending on the file of the said Court, in case the Petitioners are represented by an Advocate.

(21 However, it is made clear that the petitioners sha,ll make their appearance as and when specifically directed by tl.e trial Court to do so. r
