HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT CONTEMPT APPEAL No. 11 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This contempt appeal is directed against the order dated 17-07-2015 passed in Contempt Case No.1575 of 2014, holding the appellants guilty of contempt. By the impugned order, the appellants are sentenced to undergo simple imprisonment for a term of three months and to pay fine of Rs.1,000/- each for non-implementation of the order of this Court dated 21-08-2014 in Writ Petition No. 23696 of 2014.

We have perused the order dated 21-08-2014 passed by learned single Judge in Writ Petition No. 23696 of 2014 and the prayers made therein. When we expressed our prima facie view, learned Senior Advocates appearing for the parties, on instructions from their clients, who are present in the Court, have agreed for disposal of the appeal in terms of the following order: "The appellants shall approve the appointments of K. Sreenivasulu, K. Mysura Reddy and P. Eshwaraiah, who were appointed by respondent No.1 - contractor at 33/11 KV Sub-Station, Srinivasapuram, Mydukuru Division, and of G. Hussain Basha appointed by respondent No. 2 - Contractor at 33/11 KV Sub-Station, Kamalakuru, Mydukuru Divisioin for the period commencing from 0103-2014 till the contract between respondent Nos.1 and 2 and the Divisional Engineer (Operations) Mydukuru was subsisting and shall

communicate such approval to respondent Nos.1 and 2 and to these workmen within a period of two weeks from today. By consent, the impugned order dated 17-07-2015 passed in Contempt Case No. 1574 of 2014 is set aside. The statement made by Sri Vidyasagar, learned Senior Counsel appearing for the appellants that the appellants shall pay Rs.10,000/- (Rupees Ten Thousand only) each to the aforementioned workmen within a period of 15 days from today by demand drafts is accepted. Learned advocate on record for respondent Nos.1 and 2 shall furnish addresses of all the four workmen to the appellants for sending the demand draft, as aforementioned or it is open to the learned advocate on record for the appellants to handover four demand drafts issued in favour of the workmen to the advocate on record for respondent Nos.

1 and 2 within a period of 15 days from today. It is needles to mention that if the demand drafts are handed over to the advocate on record for respondent Nos.1 and 2, he shall forward them or handover to the four workmen within a period of ten days therefrom. In view of the approval that will be granted in pursuance of this order, if any rights are accrued to the workmen, it is open for them to take appropriate remedy for appropriate relief." With these observations, the contempt appeal is disposed of. Miscellaneous petitions, if any, also stand disposed of. _________________________ DILIP B. BHOSALE, ACJ ________________________ S.V.
