Damodar Mundra, learned counsel for respondent No.5.
This interlocutory application has been filed by the appellants to grant three months time to avail their remedy under the law and in the meanwhile to direct respondents No.2 and 3 not to forcefully dispossess the appellants from the shop premises.
We may mention that writ petition filed by the appellants, being W.P.No.17331 of 2020, was dismissed by the learned Single Judge vide order dated 30.08.2022. Thereafter, appellants preferred W.A.No.649 of 2022. By
a reasoned judgment and order dated 13.10.2022 this Court dismissed the writ appeal.
At this point of time we are not inclined to pass any order diluting the effect of the order of the learned Single Judge as well as of the Division Bench while dismissing the writ appeal. It is for the appellants to avail their remedy as provided under the law. At this stage, learned counsel for respondent No.5 submits that appellants have already vacated the shop premises, which is however disputed by Mr. J.Prabhakar, learned Senior Counsel appearing for the appellants.
Be that as it may, we are not inclined to entertain this interlocutory application, which is accordingly dismissed.
