HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO C.C.No.1657 of 2016 ORDER:

This Contempt Case is filed by the petitioners alleging willful disobedience of the order dt.03-03-2016 in W.P.M.P.No.6965 of 2016 in W.P.No.1693 of 2016.

In the affidavit filed in support of the said Contempt Case, it is stated by the petitioners that on 16-02-2016 itself, 42 houses belonging to the petitioners were demolished. Since the action of the revenue officials in demolishing houses is prior to the passing of the interim order, I am of the opinion that the respondents herein cannot be punished for Contempt of Court.

In the additional affidavit filed by the petitioners, they have stated that in the last week of July 2016, the railway contractor, to whom possession was given by the Rail Vikas Nilayam Limited for laying of the broad gauge line between Obulavaripalle of Kadapa District to Krishnapatnam port of SPSR Nellore District (which passes through the lands claimed by the petitioners), had demolished and changed the physical features. Admittedly the above act was not by the revenue officials who are made respondents in this Contempt Case.

Accordingly, the Contempt Case is closed. No costs.

MSR,J C.C.No.1657 of 2016 As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
