HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15700 of 2017 ORDER:
The case of the petitioner is that she made application dated 27.03.2017 seeking to carry out her name in the online entries and to issue E-Pass book in respect of the subject land to an extent of Ac.2.70 cents in R.S.No.495/4, situated in Avilala Village of Tirupathi Rural Mandal, Chittoor District. As the same is not being disposed of till date, present writ petition is filed.
Heard learned counsel for the petitioner who submits that in similar circumstances this Court passed order dated 19.07.2016 in WP.No.21493 of 2016.
Heard learned Assistant Government Pleader for Revenue who submits that the pattadar pass books filed by the petitioner were granted prior to commencement of new Act i.e. the A.P.Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act, 1971'); and that unless petitioner was issued pass books under the new Act, he cannot make application for carrying out her name in the online entries. In view of the above, it is open for the petitioner to make necessary application as per the provisions of the Act, 1971 to the 2nd respondent and on such application being submitted by the petitioner, the 2nd respondent is directed to dispose of
the same, in accordance with law, within a period of six weeks from the date of making application by the petitioner and take action accordingly.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ______________________________ A.RAJASHEKER REDDY, J 27.04.2017 t k.
