THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.14354 of 2016 ORDER:

The grievance of the petitioners is with regard to the action of the Greater Visakhapatnam Municipal Corporation in not carrying out mutation in its record in favour of the petitioners pursuant to their representations dated 30.12.2008 and 05.02.2009. Sri Ravi Cheemalapati, learned counsel for the petitioners, further stated that legal notice dated 27.03.2016 was also issued to the municipal authorities in this regard but they remained unmoved. Sri S. Lakshminarayana Reddy, learned Standing Counsel for the Greater Visakhapatnam Municipal Corporation, stated that the representation was still under consideration. It is not open to the municipal authorities to keep a matter of this nature pending indefinitely as mutation in the municipal records would have certain consequences which would be denied to the petitioners owing to the delay on the part of the municipal authorities in doing the needful.

As the representations made by the petitioners date back to the years 2008 and 2009, the writ petition is disposed of directing the Greater Visakhapatnam Municipal Corporation to consider the said representations and the subsequent legal notice dated 27.03.2016 and take appropriate action thereon in accordance with law. In the event the petitioners' request for mutation is rejected, the reasons therefor shall be duly recorded and communicated to them. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
