WRIT PETITION NO. 26138 OF 2015 O R D E R :

This writ petition is filed under Article 226 of the Constitution of India for the following relief : "To declare the inaction of the respondents 2 and 3 in not proceeding with the investigation in Crime No.120/2015 on the file of respondent No.3 as illegal, arbitrary and violation of bye-laws and violation of principles of natural justice and consequently to direct the respondents 2 and 3 to pass an appropriate orders to proceed with investigation in Crime No.120/2015 of respondent No.3 and to pass such other suitable orders as this court may deems fit and proper in the circumstances of the case."

2. When the matter is called, written instructions dated 24/08/2015 furnished by the Sub-Inspector of Police, Nalgonda I-Town Police Station, Nalgonda district have been placed by the learned Government Pleader for Home.

The written instructions, reads as under: "It is respectfully submitted that one Abbidi Krishna Reddy, the petitioner herein lodged complaint with the Nalgonda I-town Police Station against one Palakuri Venkatesam, the Managing Director of Sri Udaya Chit Fund [India] Pvt.Ltd., and seven others stating that the above accused approached the complainant, the petitioner Abbidi Krishna Reddy stating that they are doing chit fund business at Nalgonda from the past few years sincerely and made him to believe them, all the accused stated that they are floating a chit group of

Rs.10 lakhs payable at Rs.25,000/- per month for a period of forty months commencing from January 2012, and induced him to join the said chit.

Accordingly, the complainant has joined the chit Rs.10 lakhs bearing No. SUCF/M2/34 was allotted to him under registered bye law No.37/2012 dated 29/1/2012.

The signatures of the complainant/petitioner were obtained on all necessary papers including the chit agreement. It is also submitted that the complainant/petitioner regularly paid the monthly chit subscriptions by way of cheques as well as cash and he was allowed to participate the auction held on 19/10/2014 and declared bidder having agreed to forgo an amount of Rs.1,44,000/- and the accused liable to pay an amount of Rs.8,06,000/- prized amount but after repeated requested he was unable to pay, hence requested to take necessary action.

Basing on the complaint a case in Cr.No.120/2015 under section 406, 409, 415, 417, 420 and 120-B read with section 34 IPC of Nalgonda I-Town Police Station was registered.

The Investigation Officer took up the investigation. During the course of investigation as many as six witnesses were examined and recorded their statements. It is submitted that the investigation officer visited the scene of offence and collected all relevant documents and seized some documents related to the above said chit company. In this case, the investigation is going on. After completion of investigation, the respondent police will take steps to file the final report before the appropriate court."

4. On noticing the same, the learned counsel for the petitioner has requested this court to dispose of the writ petition by recording the said written instructions and also to direct the respondent-police authorities to expedite the investigation.

5. In view of the above, the writ petition is disposed of by recording the reasons mentioned in the written instructions, dated 24/08/2015 and the respondent-police authorities are directed to complete the investigation as expeditiously as possible. No costs.

6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
