Dr. Pentyala Sunitha v. The State Of Telangana

2018-07-31S.V.Bhatt3 pages

HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.26749 of 2018 ORDER:

Heard Mr.Srinivasa Rao for petitioner and the learned Assistant Government Pleader for Revenue.

The petitioner challenges notice dated 20.07.2018 issued by the 4th respondent.

One of the objections is that the order of this Court either misunderstood by respondents or misapplied to take up the request of 5th respondent for conducting survey on 01.08.2018 and 02.08.2018.

Mr.Srinivasa Rao after making submissions for some time informs the Court that the respondents are not receiving objections from the owners of neighbouring land and the owners are subjected to prejudice and hardship.

This Court does not want to deal with this objection on the assertion of petitioner, but, to meet the ends of justice, considers it appropriate to give liberty to petitioner to send all factual and legal objections to the Tahsildar, Kammam and also the 4th respondent by enclosing a copy of this order, by hand/ registered post with acknowledgement due.

It is needless to observe that the objections are considered within the frame work of A.P. Survey and Boundaries Act and the copy of report is also given to petitioner. Ultimately, if the petitioner

is aggrieved by the report, if any, is given liberty to work out statutory remedies before Civil Court.

The writ petition is disposed of accordingly. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 31-07-2018

1. Issue C.C. forthwith.

2. The Assistant Government Pleader is directed to inform the respondents about the order passed by this Court.
