HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.779 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner states that the appeal filed on 09.04.2015 by her is pending before the 3rd respondent-Revenue Divisional Officer, who called for report of the 4th respondent - Tahsildar, Dichpalli Mandal, Dichpalli, Nizamabad District. The petitioner relied upon the said report in letter No.A2/2471/2015, dated 04.08.2015, wherein the 4th respondent has stated that earlier the subject land was assigned to the husband of the petitioner, but before assigning it to the 5th respondent no intimation or any kind of notice was issued to the previous assignee by the office of the 4th respondent. Since the said report of the 4th respondent is already before the 3rd respondent, it is appropriate to direct the 3rd respondent to fix a date for hearing, hear the petitioner as well as the 5th respondent and take appropriate decision in the matter preferably within a period of four weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
