ORDER

This petition under Section 438 of Criminal Procedure Code is filed by petitioner/sole accused for grant of anticipatory bail in the event of his arrest in Crime No.211 of 2017 of Miyapur Police Station, Cyberabad District, registered for the offences punishable under Sections 419, 420 and 468 IPC.

The case of prosecution is that the President of Bar Association, Kukatpally Courts, Cyberabad, lodged a complaint alleging that one Mr. Siddique Syed, Advocate, submitted a complaint before the Bar Association on 10.02.2017, to enquire whether the petitioner-Mr.A. Praveen Kumar is an Advocate or not and that on enquiry, it came to the notice of the de facto complainant that the petitioner has enrolled as Advocate in Karnataka State Bar Council, Bangalore, but he did not submit any certificate issued by A.P.Bar Council as an advocate, thereby, on the strength of this complaint, the above crime was registered against the petitioner. 3.

During enquiry, it came to the notice of the Bar Association that the petitioner has submitted a fake certificate. According to the said certificate issued by Karnattaka Bar Council, his enrollment registration No.1930/2006 and Roll No.KAR/1798/2006 dated 28.07.2006 stands in the name of Rajkumar s/o.Basavantramore of Bidar. Thus, the petitioner though produced a copy of certificate allegedly issued by Karnataka State Bar Council, Bangalore, he is not a member of Bar Council. Therefore, the

MSM,J Crl.P.2163 of 2017 Certificate, prima facie, is not issued by the Bar Council of Karnataka enabling to appear in any Court in India as per Section 13 of Bar Counsel of India Act and therefore, the petitioner claiming to be advocate is allegedly cheating the litigant public so also Court. In such case, this Court cannot exercise its discretion to grant prearrest bail to the petitioner. 4.
