THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.9021 of 2013 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader appearing for the respondents. 2.

The prayer sought in the writ petition is as under:- "....to issue a writ, direction or order one in the nature of Writ of Mandamus to declare the action of 1st Respondent in not enquiring in to the complaint made by petitioner which is the subject matter of Crl.Sr.No.4917 of 2007 on the file of 1st Addl. Chief Metropolitan Magistrate at Hyderabad as illegal, arbitrary and the same is in violation of fundamental rights of citizens as guaranteed by the Constitution of India and consequently direct the 1st Respondent to enquire in to averments of the complaint made by the petitioner which is subject matter of Crl.Sr.4917 of 2007 on the file of 1st Addl. Metropolitan Magistrate, Hyderabad, and take action and pass such other orders as this Hon'ble Court deems fit and proper." 3.

Learned Government Pleader placed on record the written instructions, dated 02.08.2017, issued by the Sub-Inspector of Police, Saifabad Police Station, Hyderabad.

A perusal of the said written instructions would reveal that as per the records available in the 1st respondent Police Station, as on the date of giving written instructions, no private complaint alleged to have been filed by the petitioner herein on the file of I Additional Chief Metropolitan Magistrate, Hyderabad, vide Crl.SR.No.4917 of 2007. Therefore, the 1st respondent informed the Administrative

officer-cum-State Assistant Public Information Officer, Unit of Metropolitan Sessions Judge, that no private complaint vide Crl.SR.No.4917 of 2007 has been received.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition.

Accordingly, the writ petition is closed, giving liberty to the petitioner to avail remedies available to him as per law. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No costs.
