THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 10970 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.4 seeking bail in the event of his arrest in connection with Crime No.434 of 2023 on the file of Mailardevpally Police Station, Ranga Reddy District, registered for the offence under Section 307 r/w. 34 of IPCand Section 25(1) of Arms Act.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner approached the Session Court and the learned Sessions Judge granted the relief of anticipatory bail vide order dated 04.10.2023 in Crl.M.P.No.2420 of 2023. In the said order, petitioner was directed to surrender before the XII Additional Metropolitan Magistrate within 15 days from the date of the order. Pursuant to said surrender, he shall be released on bail on executing personal bond for Rs.25,000/- with two sureties.

Learned counsel appearing for the petitioner would submit that petitioner could not provide surety amount for which reason, he has not surrendered.

In the said circumstances of the case, the petitioner is directed to surrender before the XII Additional Metropolitan Magistrate on 20.11.2023. On such surrender, he shall be released on bail on his executing personal bond for a sum of Rs.25,000/- with two sureties, failing which, the Police are at liberty to take appropriate action. All other conditions imposed by the learned Sessions Judge shall remain unaltered. 6.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
