Heard the learned counsel for the petitioners, and the learned Government Pleader for Revenue.

The petitioners are all inter-related. The first petitioner is the owner and possessor of land to an extent of Ac.1.35 guntas situated in survey No.166 of Sirdepally village, Chandur Mandal, Nalgonda District. The pattedar passbooks and title deeds in respect of the said land were issued by the first respondent. Similarly, the second petitioner is the owner and possessor of land to an extent of Ac.1.35 guntas situated in the said survey number. The petitioners 3 to 5 are also the owners and possessors of land to an extent of 25 guntas situated in the said same survey number. Even though the overall land is under the valid title, the respondents came to the land in the first week of May 2005 and directed the petitioners not to interfere with the land stating that it is a tank land. They have not issued any show cause notice nor shown any cause preventing the petitioners from entering their land except stating that it is a tank land.

3. It is admitted that the petitioners are having pattedar passbooks and title deeds in their favour. No counter affidavit was filed by the respondents so far.

4. In the circumstances, this Writ Petition is disposed of directing the respondents not to interfere with the land of the petitioners except by following the due procedure established by law. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed.
