THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8991 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail to the petitioner/accused in the event of his arrest in connection with Crime No.235 of 2022 of Amberpet Police Station, Hyderabad District, registered for the offence punishable under Section 306 of the Indian Penal Code. 2.

Heard learned counsel for the petitioner/accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that the son of the de facto complainant committed suicide for which reason, complaint was lodged by her stating that her younger son committed suicide by hanging to a fan hook with a saree in his house. She expressed that her son might have died due to financial crisis. For the said reason, the Police registered First Information Report under Section 174 of Cr.P.C. Thereafter, an alteration memo was filed by the Police in which, it is stated that some of the witnesses have stated that the petitioner was blackmailing the deceased and harassing him mentally, as such the deceased committed suicide.

As seen from the complaint, there is no such allegation made by the mother of the deceased regarding any financial transaction with

this petitioner and the alleged constant harassment. There is no mention as to who are the witnesses, who have stated anything about this petitioner.

In the said circumstances, this Court is inclined to grant the relief of anticipatory bail to the petitioner/accused subject to the following conditions:

i) The petitioner/accused is directed to surrender before the Station House Officer, Amberpet Police Station, Hyderabad District, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused on bail, on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction.

ii) On such release, the petitioner/accused shall report before the said Station House Officer on every day at 9.00 A.M. for a period of four weeks, thereafter as and when required. iii) The petitioner/accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
