folder subject to correction s if any This application is filed by the petitioner-accused No.2 to permit him to travel to Dubai and Abu Dhabi from 22.03.2024 to 01.04.2024 by relaxing the condition imposed by this Court while granting bail on 20.11.2023 in Crl.P.No.10972 of 2023.
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
Learned counsel for the petitioner submitted that this Court granted bail to the petitioner vide order dated 20.11.2023 passed in Crl.P.No.10972 of 2023 and while granting bail, this Court imposed a condition that "the petitioner-accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C.". As per the condition (iii) of Section 438(2) of Cr.P.C., the person should not leave India without the previous permission of the Court. The petitioner was seeking permission to travel outside the country for a period of (10) days to attend his family friend's wedding in Abu Dhabi on 26.03.2024 and 27.03.2024. He further stated that the petitioner had substantial properties and several businesses in Hyderabad. The subject matter of the dispute was with regard to the property which was located in Hyderabad. The complaint was lodged by the petitioner's own brother which was mainly a civil dispute.
Learned Additional Public Prosecutor opposed to relax the condition stating that the petitioner might not return to Hyderabad, if granted permission and prayed to dismiss the application.

Considering the submission of the learned counsel for the petitioner that the petitioner was having strong roots in Hyderabad and his family was also residing in Hyderabad and was having several properties in and around Hyderabad, it is considered fit to relax the condition imposed by this Court while granting bail on 20.11.2023 in Crl.P.No.10972 of 2023. Accordingly, the petitioner-accused No.2 is permitted to travel to Dubai and Abu Dhabi from 22.03.2024 to 01.04.2024. __________ Dr.GRR,J ss
