HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT W.A.No.175 OF 2005 ORDER: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the appellants. None appears for the respondents.

This writ appeal is directed against order dated 18.03.2004 passed in W.P.No.20839 of 2001. The order reads thus: "It is represented by the learned counsel for both sides that the issue involved in this writ petition is squarely covered by a decision of this court in Wirt petition No.22480 of 1999 dated 22.01.2004.

Following the same, this writ petition is also allowed. No costs."

This Court while admitting the appeal on 11.02.2005 passed the following order:

"Writ petition was allowed in view of the decision rendered in W.P.No.22480 of 1999 dated 22-1-2004. Appeal has been preferred against the said decision viz., W.A.No.1982/04 and there is interim suspension.

Admit.

To be heard along with W.A.No.1982 of 2004."

W.A.No.1982 of 2004, arising from the order dated 22.01.2004 passed in W.P.No.22480 of 1999, has already been heard and dismissed vide order dated 21.04.2010. We have perused the said order. Having confronted with this, learned counsel appearing for the appellants fairly stated that this appeal may also be disposed of in terms of the said order. Hence, we dispose of the appeal in terms of the order dated 21.04.2010 passed in W.A.No.1982 of 2004.

The appeal is, accordingly, dismissed. No costs. Consequently, miscellaneous petitions, if any pending, also stand disposed of.
