THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2352 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ accused in Crime No.3 of 2016 of Ramagiri Police Station, Ananthapur District, registered for the offences punishable under Sections 341, 384 and 506 IPC and Sections 3 (1) (x) of SC & ST (Prevention of Atrocities) Act.
Heard the learned counsel for the petitioner/accused and the learned Public Prosecutor and perused the material available on record.
On a reading of the complaint, it is evident that there was a money transaction between the petitioner/accused and the 2nd respondent/de facto complainant and the present quarrel arose out of the said money transaction. Whether the petitioner committed the alleged offences or not is matter to be decided by the investigating agency during the course of investigation and the same cannot be decided at this stage.
Considering the facts and circumstances of the case and in view of the nature of the offences alleged, this Court is not inclined to interfere with the proceedings. However, the police of Ramagiri Police Station, Ananthapur District are directed to complete investigation without arresting the petitioner and file final report, if any, before the concerned Court.
The petitioner/accused is directed to appear before the investigating agency for the purpose of investigation as and when required and cooperative with the investigating agency.
With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
