This writ petition is filed challenging the action of respondents No.2 in collusion with the unofficial respondents threatening the petitioners to withdraw the Cr.No.174 of 2018 of Chatrinaka police station.
Learned Assistant Government Pleader produced written instructions stating that on the complaint filed by petitioners, a case in Cr.No.174 of 2013 was registered on 2007-2018 against unofficial respondents and during the course of investigation, a notice under Section 160/91 Cr.P.C. was issued to the petitioners requesting them to produce the witnesses if any and other documentary evidence. But the petitioners have not complied with the same. The allegation that the respondent-police are pressurizing the petitioners to withdraw the above case is denied. It is stated that the respondent-police will complete the investigation of the crime in impartial and fair manner and no malafides can be attributed to the same.
In view of the same, recording the same, the writ petition is disposed of directing the respondent-police not to pressurize the petitioners to withdraw Cr.No.174 of 2013 of Chatrinaka police station. It is always open for the petitioners to cooperate with the investigation conducted by respondent No.3.
