THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 29353 OF 2017 O R D E R :

This Writ Petition is filed to declare the proceedings No. B/13/2009 in passing the Award dated 19.02.2013 as illegal and arbitrary and consequently, to direct the respondents to pay the compensation in respect of House No. 7-58 of Cheerlavancha Village, Sirsilla Mandal, Karimnagar District duly initiating the proceedings under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

On behalf of the respondents, a counter-affidavit has been filed by the 4th respondent - Special Deputy Collector (Land Acquisition). In paragraph 6 thereof, it is stated that the petitioner has been paid the compensation of Rs.11,96,752/- based on the estimated structure value of Rs.3,60,000/- above with additional market value and interest from the date of notification i.e. from 02.03.2009 to 11.10.2017 under proper acknowledgment. Heard learned counsel for the petitioner as well as learned Government Pleader for Land Acquisition.

Since there is no rebuttal to the specific assertion of the 4th respondent made in the counter-affidavit and inasmuch as the grievance of the petitioner has been redressed by paying the compensation amount, without going into the merits of the matter, the Writ Petition is closed, leaving it open to the petitioner to work out the remedies, if any as regards the adequacy or otherwise of the compensation, if she is so advised. No costs.

Consequently, the miscellaneous Applications, if any shall also stand closed.
