THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2828 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-3 to A-5 in Crime No.29 of 2016 on the file of Jaggaiahpet Police Station Krishna District registered for the offences punishable under Sections 306 IPC.

Heard and perused the material on record.

It is alleged that one Krishna Kishore, the husband of the 2nd respondent/de facto complainant, who conducted earlier a gold business, has given a shop owned by him to one Divvela Udayalakshmi and her son on lease and that the said persons have paid six months rent and thereafter they failed to pay the rent and that when the husband of the 2nd respondent asked them for payment of rent, he was abused and was subjected to mental agony by the petitioners and other accused. It is further alleged that on 08-02-2016 the husband of the 2nd respondent, on returning from the Court, has committed suicide by hanging himself to death by keeping a suicide note in his pocket in which the names of the petitioners and other accused were mentioned.

A reading of the material and the complaint would reveal that specific allegations are alleged against the petitioners constituting the offence, much less the alleged offence, the truth or otherwise of which can be ascertained only during the course of investigation and the same cannot be determined at this stage. It is stated that the crime is under investigation.

circumstances, this Court is not inclined to interfere with the proceedings against the petitioners, and hence, the criminal petition is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand closed.
