This writ petition is filed under Article 226 of the Constitution of India for the following relief :
"To declare the action of the respondents 2 and 3 in not providing police protection to the life and property of the petitioner on his complaint/representation dated 22/9/2015 as illegal, arbitrary, violative of principles of natural justice and also in violation of Articles 14, 19 and 21 of the Constitution of India and consequently to direct the respondents 2 and 3 to provide police protection to the life as well as the property of the petitioner and to pass such other suitable orders as this court may deems fit and proper in the circumstances of
the case."
2. Heard Sri Mohammed Moin Ahmed Quadri, learned counsel for the petitioner and the learned Government Pleader for Home for the respondents.
3. When the matter is called, written instructions dated 03/10/2015 furnished by the Sub-Inspector of Police, Pahadisharif Police Station, Hyderabad, have been placed on record by the learned Government Pleader for Home for the respondents.
3. The written instructions, reads as under:
"It is submitted that on receipt of the communication about the filing of the writ petition by the petitioner herein, this respondent has thoroughly verified the records as to whether any complaint/representation dated 22/9/2015 has been received from the petitioner herein. No such complaint/representation was received in this respondent police station till date and hence no action was taken up.
It is submitted that it is always open for the petitioner to approach this respondent police station to give any fresh complaint or the complaint dated 22/9/2015 and on receipt of the same, certainly action will be taken against the concerned in accordance with law."
4. On noticing the same, the learned counsel for the petitioner has requested this court to dispose of the writ petition by recording the said written
instructions.
5. In view of the above, the writ petition is disposed of by recording the above written instructions furnished by the Sub-Inspector of Police, Pahadisharif Police Station, Hyderabad district while keeping it open for the petitioner to make a complaint afresh and on receipt of the same appropriate action may be taken by the respondent-police as per law. No costs.
6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
