THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.12310 OF 2015 Date:29.04.2015 Between:

Sri Rajula Yadaiah .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Department of Home, Secretariat, Hyderabad and others .. Respondents

THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.12310 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for

Home appearing for respondents 1 to 3.

There appears to be a dispute between the petitioner and his brother, who is shown as unofficial respondent No.5, and the dispute appears to be with reference to land in Survey No.678 of Chattanpally Village, Farooq Nagar Mandal, Mahaboob Nagar District. Alleging that respondent No.3 is calling the petitioner to Police Station and threatening him without there being any crime registered against him, the present Writ Petition is filed.

The instructions of learned Government Pleader for Home show that the complaint lodged by the petitioner in Crime No.182 of 2015 was already registered on 14.04.2015 against respondents 5 to 7 on the allegation of criminal trespass. Similarly, respondent No.5 also filed a complaint, based on which, Crime No.187 of 2015 was registered on 18.04.2015 and the petitioner is shown as A-1 in the said F.I.R. While the investigation in both the crimes are pending, it is stated that the petitioner's presence is required in connection with Crime No.187 of 2015 and the presence of the unofficial respondents is required in Crime No.182 of 2015 and for that purpose, necessary steps are being taken by following due procedure. However, respondent No.

3 states that except investigation in the aforesaid crimes in accordance with law, he never threatened the petitioner, as alleged. In view of the said categorical statement, there is no reason to accept the petitioner's allegation that there is any threat by respondent No.3, as alleged. It is, therefore, made clear that respondent No.3 shall confine himself to investigation of the said crimes in accordance with law and take expeditious steps for completion of investigation.

The Writ Petition is accordingly, disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
