THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5613 OF 2017 ORDER:
This writ petition is filed challenging the notice dated 19.01.2017 issued by the 4th respondent under Section 3(2) of the A.P.Assigned Lands Act, 1977, in respect of the lands to an extent of Ac.10.08 cents in Survey No.293 of Chollangi Village, East Godavari District.
Heard both sides.
It is not the case of the petitioners that the 4th respondent lacks his inherent jurisdiction in issuing the impugned notice. Normally, this Court will not interfere with the issuance of show cause notice. The factual aspects pleaded before this Court by the petitioner in the writ affidavit can be pleaded before the respondent authorities by way of filing explanation, and the respondent authorities shall consider the said objections filed by the petitioners and take action. In view of the same, I do not see any reason to entertain this writ petition. Accordingly, the writ petition is dismissed. However, it is open for the petitioners to submit explanation to the show cause notice dated 19.01.2017 within four weeks from today, and on such explanation being filed by the petitioners, the 4th respondent shall pass final orders after giving opportunity of hearing to the petitioner. Till passing of final orders, status quo obtaining as on today shall be maintained. If petitioner fails to
submit explanation within four weeks, it is open for the respondents to take appropriate action in accordance with law. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 17.02.2017 t k.
