Heard Mr.Suresh holding for Ms.Ramani Annam for petitioners and the learned Assistant Government Pleader for respondents.

The petitioners pray for the following relief: ".........Writ of Mandamus declaring the action of the Respondents in trying to dispossess the petitioners from the lands situated in Sy.No.51, 52, 91 of Nanginarapadu Village and in Sy.No.20/1, 20/5, 57, 58 and 59 in Gangavaram village, Sabbavaram mandal, Vishakapatnam district without following law as illegal arbitrary and violation of Article 14, 21 and 300(a) of the Constitution of India and consequently direct the Respondents not to dispossess the Petitioners from the lands situated in Sy.No.51, 52, 91 of Nanginarapadu Village and in Sy.No.20/1, 20/5, 57, 58 and 59 in Gangavaram village, Sabbavaram mandal, Vishakapatnam district.........."

On 01.08.2018, at the request of respondents, the writ petition is directed to be listed for admission today. The Assistant Government Pleader places on record, the written instructions dated 01.08.2018 received from 3rd respondent. The instructions are accepted.

The Assistant Government Pleader further submits that the sub-ordinate officers of respondent Nos.2 and 3 inspected the subject matter for verification of field and to find out the survey stones etc. The visit of the sub-ordinate officers of respondents is misunderstood as steps taken for dispossessing the petitioners. Therefore, the cause of action

is a mere apprehension. He further states that the respondents would follow the procedure stipulated by law in the event of subject land is required for public purpose or resumed for violation of statutory provision. The statement is placed on record and accepted. Writ petition is disposed of accordingly. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
