THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.11096 of 2013 ORDER:

The petitioner prays for the following relief :- " ...... to issue a Writ, one in the nature of a Writ of Mandamus, declaring the action of the respondents 3 to 5 in issuing Sand Bid Notification in local News Papers of Khammam District vide Notification No.Special/ Sand/ 2013, Dt. 28.03.2013 calling for application from the applicants who are intended to participate in the bids for sand reaches in Bhadrachalam division, is illegal, arbitrary and contrary to violation of principles of natural Justice and consequently direct the respondent Nos. 3 to 5, the resolution passed by the 3rd respondent regarding to purchase the sand in our favour on 03.03.2013 is still subsisting in so far Morravanigudem reach is concerned ....."

According to Sri Pandu Ranga Reddy, even after exploiting the quantities specified in the Notification dated 28-03-2013, sufficient sand mineral at subject site is available for allotment to petitioner. According to extant rules, the petitioner being an allottee from Gram Panchayat is entitled for c onsideration. He requests the Court to give liberty to petitioner to represent to respondents in this behalf for necessary relief and does not press the writ prayer.

The writ petition is dismissed as not pressed, however, by granting liberty as prayed for. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 21-04-2017 Prv
