THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION Nos. 1004, 835, 1202, 1236 & 1259 OF 2017 COMMON ORDER :

Heard. With the consent of both parties, the Writ Petitions are disposed of at the admission stage.

In all these writ petitions, petitioners challenge suspension of licence of toddy shops of the petitioners. The challenge is primarily on the ground that in the criminal proceedings initiated against the petitioners, the criminal Court found them not guilty and acquitted of the charges levelled against them, which was the basis for suspending the licence granted to the petitioners under the Andhra Pradesh Excise Act.

When the matters are taken up for consideration learned Government Pleader submits that the licence of petitioners were cancelled long ago i.e., by order dated 12.06.2013. Petitioners have not challenged the said orders, and the present writ petitions are not maintainable and are liable to be dismissed on that ground alone.

Thus, having regard to the submissions made by learned Government Pleader, the Writ Petitions are dismissed as not maintainable, in view of the fact that the suspension subsequently merged into cancellation of licence by order dated 12.06.2013. If petitioners have any subsisting grievance against such cancellation, they should work out their remedies in accordance with law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
