CVNR, J & MSKJ, J C.M.A.No.971 of 2005 27.10.2016 JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This civil miscellaneous appeal arises out of the order, dated 05.07.2005, in D.O.P.No.5 of 2001 on the file of I Additional District Judge, Ongole, whereby, he has granted decree for restitution of conjugal rights in favour of the respondent.

At the hearing, Mrs.I.Maamu Vani, learned counsel for the appellant, has submitted that during the pendency of this appeal, the petition filed by her client for dissolution of marriage with the respondent was decreed on 17.05.2007 and that the said decree has not been questioned by the respondent.

In view of the above subsequent event, the cause in this appeal does not survive for adjudication.

The Civil Miscellaneous Appeal is, accordingly, disposed of as infructuous.
