ORDER:

Petitioner No.1 is the second wife and petitioners 2 and 3 are children of one Late A. Narsaiah. Petitioners claim that a Will was executed in favour of petitioner No.1 by the deceased A. Narsaiah. Petitioners have filed the present writ petition questioning the action of the third respondent in summoning them to the police station and pressurizing them to compromise the matter with respondents 4 and 5 without registering any FIR.

2. Instructions of the learned Assistant Government Pleader show that fourth respondent herein approached the third respondent and lodged a complaint on 29.03.2015 against the petitioners, which was noted in the General Diary and after conducting preliminary enquiry, it was noticed that the dispute between the parties is purely of civil nature. Hence, the third respondent has not taken any further action but has advised the complainant to go the appropriate civil Court.

The allegation of the petitioners regarding pressurizing them to settle the matter etc. is denied.

3. In view of the fact that, after the preliminary enquiry, no action is taken by the third respondent but only advised the parties to approach the civil Court, nothing further survives for consideration in the writ petition.
