HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.26838 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 3rd respondent in not considering the application dated 19.7.2018, submitted by the petitioner to conduct survey of the lands admeasuring Ac.0.32 and Ac.0.36 1⁄2 guntas, situated at Sy.No.571/B/1 and Sy.No.571/B/3 respectively of Dacharam Village, Bejjanki Mandal, Siddipet District, as illegal and arbitrary.

The grievance of the petitioner is that even though she submitted an application on 19.7.2018 to the 3rd respondent-Assistant Director (Survey & Land Records) to demarcate the boundaries of agricultural land by F-Line and paid the challan in meeseva with application No.DERPO21800290669, the 3rd respondent did not take any action so far.

Learned Government Pleader for Revenue placed on record the written instructions issued by the Tahsildar, Bejjanki Mandal stating that the Mandal Surveyor, Bejjanki has already conducted survey and submitted his report along with a sketch map and panchanama on 11.7.2018, but the petitioner has not agreed for the said survey and she has not signed on panchanama. The same is denied by the learned counsel for the petitioner stating that when the petitioner herself made an application, the question of refusing to cooperate with the survey and signing on the panchanama, would not arise.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-Assistant Director (Survey & Land Records), to conduct the survey of the lands of the petitioner admeasuring Ac.0.32 and Ac.0.36 1⁄2 guntas, situated at Sy.No.571/B/1 and Sy.No.571/B/3 respectively of Dacharam Village, Bejjanki Mandal, Siddipet District on 27.8.2018, pursuant to the

application dated 19.7.2018 of the petitioner and the petitioner shall be present at the spot, along with the relevant documents by 11.00 a.m on 27.8.2018. It is needless to mention that no further notice shall be issued by the 3rd respondent about the survey which is going to be conducted on 27.8.2018.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
