O R D E R

The case of the petitioners is that they made representations dated 8.9.2016 and 28.12.2016 to the 2nd respondent - District Collector for deletion of the subject land in an extent of Acs.12.54 cents situated at Neravada village of Panyam Manal from the list of prohibited properties under Section 22-A of the Registration Act, 1908 (for short 'the Act'). In pursuance of the same, the 2nd respondent addressed letter to the 4th respondent - Tahsildar in L.Dis.E2. REVESECOLAS(NOC)/ 1/ 2017-JA(E)-COLLKRNL. dated 10.1.2017, to submit report as per the revenue records along with proposals through Revenue Divisional Officer, Nandyal under Section 22A(i) of the Act for taking further action. As no report has been submitted and consequently no action has been taken on the representations of the petitioners', the present writ petition is filed.

The learned counsel for the petitioners submitted that the predecessors in title of the petitioners were allotted the subject land under freedom fighters category. As per G.O.Ms.No.279 Revenue (Assn.I) Department dated 4.7.2016, such lands allotted to freedom fighters can be alienated after a period of ten years of assignment, and as such it was alienated and the petitioners became the owners and possessors.

has been entered in the prohibited list under Section 22-A of the Act and hence, they are not in a position to alienate the same. For deleting the same from the prohibited list, they made representations and as no action has been taken, the present writ petition is filed. The learned counsel, therefore, seeks for passing appropriate directions. Heard the learned Assistant Government Pleader for Revenue. Having regard to the facts and circumstances, without expressing any opinion on merits, the writ petition is disposed of at the stage of admission, directing the 2nd respondent to act on the letter dated 10.1.2017 addressed by him to the 4th respondent - Tahsildar and consider the representations of the petitioners' dated 8.9.2016 and 28.12.2016 and dispose of the same in accordance with law, within a period of three months from the date of receipt of a copy of this order. No costs.
