THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 25157 of 2015 ORDER:

Heard learned counsel for the parties.

The grievance of the petitioners in this writ petition is similar to the petitioners in W.P.No. 23694 of 2015, which was disposed of on 19.8.2015. In the present case also the names of the writ petitioners were not found in the preliminary notification under Section 11 of the Central Act 30/2013 published in Telangana State Gazette Extraordinary, dated 9.3.2015, however they are shown in the second notification under Section 19 of the said Act published in the Telangana State Gazette Extraordinary, dated 7.7.2015. It is stated that the petitioners in this case have already participated in the award enquiry. Hence in terms of the aforesaid judgment, this writ petition is disposed of giving liberty to the respondents to publish either a fresh notification under Section 11 of the said Act or an errata to the preliminary notification.

The preliminary notification dated 9.3.2015 to the extent of petitioners' properties shall not be given effect to till an errata to it or a fresh notification is issued and published. Miscellaneous applications, if any, shall stand closed. No order as to costs.
