THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.11783 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for

Home appearing for the respondents.

The petitioner complains of unlawful interference by respondents 4 and 5 and states that though there is no complaint or case registered against him, they are interfering with his agricultural land.

The instructions of learned Government Pleader for Home, however, show that respondents 4 and 5 have received a complaint, dated 22.06.2014, from one Sunkara Subba Ram Kumar, which was registered as Crime No.117 of 2014 against the petitioner; during investigation, the Investigating Officer visited the scene of offence; subsequently on completion of investigation, charge sheet was filed on 12.07.2014 and the said case is pending trial in C.C.No.148 of 2014 before the Judicial Magistrate of First Class, Mummidivaram. It is specifically stated that after filing of charge sheet, respondent Police never called the petitioner to Police Station and there is no interference whatsoever and that visiting the scene of offence during investigation would not amount to mean interference and harassment by them.

Since it is categorically stated that after filing of charge sheet in Crime No.117 of 2014, the petitioner was never called to Police Station and there is no question of any harassment, the present Writ Petition appears to have been filed only on an apprehension. However, if any complaint of cognisable offence is received against the petitioner, the respondent Police are at liberty to take appropriate action in accordance with law.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
