HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.27282 of 2018

ORDER

This writ petition is filed seeking the following relief: "to issue an appropriate writ, order or direction more especially one in the nature of Writ of Mandamus declaring the proceedings in Rc.No.2978/2018-WS, dated 29.5.2018 issued by the 2nd respondent, pursuant to the letter of the 3rd respondent in RC.No.1359/2017-D, dated 11.4.2018, is bad, illegal, and without jurisdiction and consequently to set aside the same as biased in nature in the interest of justice and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

When the matter is taken up for hearing, learned Government Pleader appearing for respondents 1 to 3 contended that the petitioners cannot challenge the notice ordering enquiry dated 29.5.2018. The respondents have conducted enquiry and submitted a report. If at all the petitioners are aggrieved, they must challenge the enquiry report, but at this point of time, the cause in the writ petition does not survive for adjudication.

Learned counsel appearing for the petitioners does not dispute the same. It is prayed that the petitioners be given liberty to challenge the enquiry report, in accordance with law.

In view of the same, the Writ Petition is dismissed as infructuous. However, the petitioners are at liberty to challenge the enquiry report, in accordance with law. No costs.

Pending miscellaneous petitions, if any, shall stand closed.
