THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.9152 OF 2015 ORDER:

The petitioner was appointed as Fair Price Shop dealer of P.K.Cheruvu village. While so, a show cause notice was issued by the 3rd respondent basing on the report submitted by the 4th respondent, dated 16-08-2014. There were five charges against the petitioner. The petitioner submitted her explanation and also filed Writ Petition No.26857 of 2014. This Court disposed of the said writ petition on 11-09-2014 filed against the order of suspension by suspending the order of suspension dated 16-08-2014 and directed the appellate authority to dispose of the appeal. Later on final order was passed. Pursuant to disposal of the appeal by the 2nd respondent on 03-11-2014, on 16-032015, the 3rd respondent passed an order cancelling the authorization of the petitioner. The petitioner preferred an appeal to the 2nd respondent on 24-03-2015 along with application for stay. When the same was not disposed of, the petitioner filed the present writ petition. 2.

Since against the impugned order of cancellation of authorization, dated 16-03-2015, appeal is pending before the 2nd respondent, this Court is not inclined to go into the merits of the case. The 2nd respondent is directed to enquire into the appeal preferred by the petitioner and pass appropriate orders thereon within a period of 60 days from the date of receipt of a copy of this order by giving due opportunity to the petitioner.

3. The writ petition is accordingly, disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
