THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19036 of 2007 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the 2nd respondent in promoting the 3rd and 4th respondents as Superintendents, vide proceedings, dated 15.08.2007, as arbitrary and illegal and consequently, to set aside the same and direct the 2nd respondent to promote the petitioner as Superintendent in pursuance of G.O.Ms.No.2, dated 09.01.2007 and Memo No.53975/Ser.D/2000-3, dated 09.01.2001. 2.

Heard the arguments of learned counsel for the petitioner and learned counsel for the respondents.

This Court by an order, dated 07.09.2007, directed the respondents to consider the case of the petitioner for promotion to the post of Superintendent against Scheduled Tribe vacancy i.e., 8th roaster point in the category strength of Superintendents, if there are no women candidates available in the category of Senior Assistant eligible for promotion to the post of Superintendent and pass appropriate orders as per law, within a period of four weeks from the date of receipt of a copy of this order.

Pursuant to the order passed by this Court, the petitioner made a representation on 16.08.2007 to consider his case for promotion to the post of Superintendent against Scheduled Tribe vacancy. The said representation came to be rejected vide proceedings Rc.No.A1/2284/2007, dated 10.10.2007, by the Executive Officer, Srisailam Devasthanam, Srisailam. Challenging the same, the

petitioner filed W.P.No.23544 of 2007 and the same is pending for consideration.

In view of the above, nothing survives in this writ petition for further adjudication.

Accordingly, the Writ Petition is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
