ORDER

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 3.

This writ petition is filed seeking to declare the action of the 3rd respondent in not releasing the essential commodities to the fair price shop of the petitioner, as arbitrary and illegal. Petitioner is the dealer of fair price shop No.6, Valivarthypadu Village, Gudivada Mandal, Krishna District. While so, on 11.5.2015, the Regional Vigilance & Enforcement Officer along with Special Tahsildar, Vijayawada, inspected the fair price shop of the petitioner and found variations in the stock. Thereafter, proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act') were initiated against the petitioner and since then, the respondents are not supplying the essential commodities to her fair price shop. Challenging the same, the present writ petition has been filed. The grievance of the petitioner is that when she approached the 3rd respondent along with demand draft for supply of essential commodities, he refused to receive the same on the premise of pending proceedings under Section 6-A of the Act.

Though the matter was adjourned on 3.6.2015 for instructions of the learned Government Pleader, no instructions have been received so far.

In the circumstances, the Writ Petition is disposed of

directing the 2nd respondent to release the essential commodities to the fair price shop of the petitioner, if her authorization is subsisting as on today. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
