THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11021 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.151 of 2023 on the file of Havli Police Station, Ghanpur, Medak District, registered for the offences under Sections 376(2) (l) (n),
(3) of IPC and Section 5(l) r/w. 6 of POCSO (Amendment) Act, 2019.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that this petitioner and the victim girl were acquainted with each other. They used to talk over phone and chat on instagram. This petitioner allegedly promised to marry her and also had physical contact. Since her periods stopped, she informed the same to her mother, who took her to a Doctor and it was informed by the Doctor that she was carrying seven months pregnancy. Having came to know that this petitioner was allegedly responsible for pregnancy, a criminal complaint was filed. The said complaint was
investigated and charge sheet was filed. Samples for DNA testing were also taken, which is pending of result. 4.
Keeping in view that entire investigation is complete, the relief of regular bail can be considered, subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of the I Additional District & Sessions Judge at Medak.
ii) The petitioner/Accused after release shall appear before the concerned Court on every date of hearing. (iii) The petitioner/Accused in any manner shall not try to contact either the victim girl or her relatives. Failing which, the Police are at liberty to seek cancellation of bail granted.
iv) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 5.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
