THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8984 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C."), seeking to enlarge the petitioners/accused Nos.1 and 2 on bail in connection with Crime No.121 of 2022 of Devaruppala Police Station, Warangal Commissionerate, registered for the offences punishable under Sections 448, 294(b), 324, 306 read with 34 of the Indian Penal Code. 2.

Heard learned counsel for the petitioners/accused Nos.1 and 2 and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the deceased committed suicide unable to bear the beating by these petitioners and three others. The alleged incident took place on 07.08.2022 and thereafter on 11.08.2022 on which date the deceased committed suicide by consuming pesticides poison. On the said two dates, it is alleged in the complaint that these petitioners along with three others beat the deceased.

The case is one of altercation due to differences amongst the families in the community. Since these petitioners are in jail from

23.08.2022, the prayer for bail can be considered on the following conditions:

i) The petitioners/accused Nos.1 and 2 are directed to be released on bail on their executing personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the Additional Judicial First Class Magistrate, at Jangaon. ii) The petitioner/accused No.1 shall appear before the concerned Police on every Monday between 10.00 A.M. and 04.00 P.M., for a period of three months or until filing of charge sheet, whichever is earlier.

ii) The petitioner/accused No.2 shall appear before concerned Police as and when required for the purpose of investigation.

iii) The petitioners/accused Nos.1 and 2 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
