The petitioners challenge the Form-2 notice dated 02-11-2016 issued by the 4th respondent under Rule 3
(2) of A.P.Assigned Lands (Prohibition of Transfers) Act, 1977.
Learned counsel for the petitioners submits that the petitioners purchased the subject land through registered sale deeds. Basing on the same, the 4th respondent who issued impugned notice granted pattadar passbooks and title deeds. As such, the 4th respondent is estopped from issuing the impugned notice.
On the other hand, learned Assistant Government Pleader submits that the impugned notice is only showcause notice, the petitioners can submit their explanation to the same before the 4th respondent stating all those facts.
It is to be seen that normally this Court will not interfere at the stage of show-cause notice. In view of the same, it is open for the petitioners to submit their explanation to the impugned show-cause notice dated 02-11-2016 within a period of four weeks from today and on submitting such explanation, the 4th respondent shall
pass final orders after considering the objections of the petitioners by giving opportunity of hearing to them within a period of four weeks thereafter. Till passing of final orders, the petitioners shall not be dispossessed from the subject lands.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 20-04-2017 nvl
