HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3444 OF 2017 ORDER:

This Criminal Petition, under Section 389 (1) of the Code of Criminal Procedure, 1973, is filed seeking to relax the condition to deposit 1/4th of the compensation amount i.e., Rs.1,25,000/- imposed vide order, dated 07.04.2017, in Crl.M.P.No.45 of 2017 in Crl.A.No.427 of 2017 by the learned Additional Metropolitan Sessions Judge, Cyberabad at L.B. Nagar, Hyderabad.

2. Heard Sri M.V. Praveen Kumar, learned counsel for the petitioner, and the learned Additional Public Prosecutor for the State of Telangana.

3. In view of the Certificate, dated 26.02.2017, issued by the Medical Superintendent, Sai Krishna Super Speciality Neuro Hospital, Kachiguda, showing that the petitioner has been suffering with 'left hemiplegia' with 'right parietal bleed' and knee joint dislocation, 1/4th of the compensation amount, working out to Rs.1,25,000/-, directed to be deposited by the Court below is reduced to Rs.75,000/- (Rupees seventy five thousand only) modifying the order, dated 07.04.2017, passed in Crl.M.P.No.45 of 2017 in Crl.A.No.427 of 2017 by the learned Additional Metropolitan Sessions Judge, Cyberabad at L.B. Nagar, Hyderabad. The petitioner is directed to deposit the said amount within a period of eight (8) weeks from today.

4. Accordingly, the Criminal Petition is disposed of. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
