HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.16719 OF 2016 ORDER:

This petition is filed under Section 482 of Cr.P.C. to quash Cr.No.10 of 2014 of Hindupur Rural Police Station, Hindupur, Anantapuramu District, for the offences punishable under Sections 420, 423, 464, 468, 471 and Section 120-A of I.P.C.

Respondent filed private complaint before Judicial Magistrate of First Class, Hindupur and the same was referred to police by exercising powers under Section 156 (3) of Cr.P.C. and on the strength of such reference, police registered the same as a case in Cr.No.10 of 2014 for the offences punishable under the above Sections.

It is brought to the notice of this court that the investigation in this case is completed and Charge Sheet is filed before the Judicial First Class Magistrate, Hindupur 14-1-2016 and thereby, the proceedings in the above crime are merged with the charge sheet now and at this stage, the proceedings in the above said crime cannot be quashed and therefore, the petition became infructuous and the same is dismissed as infructuous. However, liberty is granted to challenge the proceedings in calendar case if it is otherwise so advised.
