HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.M.P.No.5888 of 2015 and CRIMINAL PETITION No.3057 OF 2015 ORDER:

This Criminal Petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in S.C.No.51 of 2015 on the file of Metropolitan Sessions Judge, City Criminal Court, Hyderabad, where charges were framed against the accused for the offence punishable under Sections 306 and 498-A I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the State and the learned counsel for respondent No.2/de facto complainant.

Pending disposal of the criminal petition filed by the petitioner, who is no other than father of the deceased-Sonali@ Archana, Crl.M.P.No.5888 of 2015 is filed seeking seeking permission of the Court to compound the offence in the above said S.C.

Both parties present. In fact the matter is heard and reserved for orders. At this stage, in the course of hearing in fact already submitted as part of the material papers, the memorandum of understanding between the parties

to settle the matter covered by page No.29. Reiterating the same, the parties filed petition seeking permission to compromise the matter by compounding.

Though the offence under Section 306 I.P.C. is not compoundable under Section 320 Cr.P.C. by invoking Section 482 Cr.P.C. the same is compounded.

Accordingly, this criminal petition is allowed quashing the proceedings in S.C.No.51 of 2015 on the file of Metropolitan Sessions Judge, City Criminal Court, Hyderabad. The bail bonds of the accused shall stand cancelled.

Miscellaneous petitions pending if any, shall stand closed.
