THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SMT. JUSTI CE KONGARA VI JAYA LAKSHMI L.A.A.S.NO.657 OF 2011 JUDGMENT: (per SK,J) This appeal under Section 54 of the Land Acquisition Act, 1894, arises out of the common order dated 28.02.2005 passed by the learned Senior Civil Judge, Nandikotkur, in so far as it pertains to O.P.No.29 of 2000.

We are informed that L.A.A.S.No.7 of 2006 and batch arising out of the very same common order in relation to the other O.Ps. was decided by this Court on 07.02.2011, whereby the common order dated 28.02.2005 passed by the learned Senior Civil Judge, Nandikotkur, was set aside and the matter was remitted back to the Reference Court for fresh disposal. Both sides were also granted liberty to adduce evidence, if they chose to do so.

For reasons alike as were stated in the aforestated judgment and in terms thereof, this appeal is allowed setting aside the common order under appeal in so far as it relates to O.P.No.29 of 2000. The matter is remitted to the Senior Civil Judge, Nandikotkur, for consideration afresh on merits and in accordance with law. The parties are at liberty to adduce evidence, if they so choose.
