This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in D.V.C.No.5 of 2018 registered against the petitioners under Section 12 of Protection of Women From Domestic Violence Act, 2005 (for short 'the Act') pending on the file of the Judicial First Class Magistrate, Alair, Yadradri District, on various grounds.
Learned counsel for the petitioners, after arguing the matter for a while, requested this Court to dispense with the personal appearance of the petitioners in the above DVCT.
The parties are not required to appear on every date of adjournment and more or less it is a quasi civil in nature, and this Court in Giduthuri Kesari Kumar and others v. State of Telangana Rep. by Public Prosecutor and another1 clarified the legal position directing the Magistrate not to insist the parties on every date of adjournment. Accordingly, the criminal petition is disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
