HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.12714 of 2024 ORDER :

Petitioner/accused No.4 has filed this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short 'BNSS') seeking anticipatory bail in Cr.No.68 of 2024 of Rudrangi Police Station, Rajanna Sircilla District registered for the offence under Section 8 c r/w 20 (b) (ii) (A) of NDPS Act, 1985.

Heard Mr.B.Arjun Reddy, learned counsel appearing on behalf of Mr.K.Venkatesh, learned counsel for petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the State and perused the record. 3.

The allegation against the petitioner/accused No.4 is that himself along with other accused were involved in purchase and sale of Ganja.

Learned counsel for petitioner/accused No.4 submits that petitioner is innocent and was falsely implicated in this offence

JS, J Crl.P.No.12714 of 2024 and he is no way concerned with the other accused persons and there is no specific allegation against the petitioner/accused No.4. He further submits that the petitioner/accused No.4 is apprehending arrest and hence, prayed to grant anticipatory bail. 5.

The learned Additional Public Prosecutor, on the other hand, opposed the application stating that serious allegations are leveled against petitioner/accused No.4 and hence prayed to dismiss the petition.

Having heard both sides and on perusal of material placed on record, it is apparent from the remand report that basing on the confession of accused No.1 only accused No.4 was implicated in this crime and contraband of 250 grams of ganja was seized from the possession of accused No.1 only and there are no criminal antecedents reported against the accused No.4. In the said circumstances, this Court is inclined to grant bail to the petitioner/accused No.4, subject to the following conditions:

1. The petitioner/accused No.4 shall surrender before the Station House Officer of P.S.

Rudrangi, Rajanna Sircilla District within two

JS, J Crl.P.No.12714 of 2024 weeks from today, and on such surrender, the said Station House Officer shall release him on bail on his executing a personal bond for Rs.10,000/- each with two sureties each for the like sum.

2. The petitioner/accused No.4 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Petition is allowed accordingly.
