HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 192 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Sri K.S. Murthy, learned counsel for the appellants, in view of the subsequent events, does not press this appeal on merits and seeks liberty to the appellants to take appropriate remedy for redressal of their grievance and also to raise contention that there is no public road, as contended by the respondent - Corporation, on which the appellants allegedly encroached upon. Appeal is dismissed as withdrawn. It is open to the appellants to take appropriate remedy, if any, for redressal of their grievance and raise whatever contentions they want in support of their case. While making this observation, we shall not be understood to have expressed any opinion on the contentions the appellants propose to raise in the proceedings they intend to initiate, including their claim that the road is not a public road. Miscellaneous petitions, if any, shall also stand dismissed.
