ORDER

This writ petition is filed by the General Power of Attorney holder of the petitioner stating that the petitioner is his son, who obtained passport bearing No.A 5284979, on 6.4.1998 from the Regional Passport Office, Secunderabad, wherein his place of birth was mentioned as "Vakkalagadda", A.P. The said passport expired by 5.4.2008. Before expiry of the said passport, when the petitioner applied for renewal of the same, a new passport bearing No.G 2554181 was issued on 16.3.2007. All the particulars in the new passport tallied with old passport except place of birth. The place of birth of the petitioner was wrongly mentioned as "Hyderabad" instead "Vakkalagadda". The said wrong entry was not noticed by the petitioner and he went abroad. Hence, his father submitted a representation to the 2nd respondent on 14.6.

2016 requesting to correct the place of birth as "Vakkalagadda" in the place of Hyderabad, as stated in the old passport bearing No.A 5284979, dated 6.4.1998. It appears that father of the petitioner personally went to Regional Passport Office, Secunderabad and requested the 2nd respondent to rectify the mistake.

the same, no action was taken thereon. Hence, the present writ petition is filed.

Even after lapse of four months, no counter-affidavit is filed by the 2nd respondent. But, learned counsel appearing for the 2nd respondent submits that the petitioner has to apply afresh.

Since this Court is satisfied that the said mistake was committed by the 2nd respondent while renewing the passport, it is for the 2nd respondent to rectify the same. Learned counsel appearing for the petitioner also brought to the notice of this Court that Office Memorandum dated 26.11.2015 issued by the Ministry of External Affairs enables the 2nd respondent to correct the clerical mistakes. In the circumstances, this Writ Petition is allowed by directing the 2nd respondent to correct the said mistake by issuing a fresh passport as and when the petitioner surrenders the old passport. No costs.
