THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10612 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in crime No.139 of 2015 on the file of the Kasibugga Police Station, Srikakulam District, registered for the offences under Sections 406 and 408 IPC. Heard and perused the material available on record. The allegation against the petitioner herein is that he, being the outsourcing person engaged by the officials of APSRTC, collected huge amounts from various persons to a tune of Rs.1 lakh and he has also committed theft of receipt books.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is a law abiding citizen and he is ready and willing to cooperate with the investigating agency and as such, he prays this Court to grant anticipatory bail to the petitioner herein. Considering the facts and circumstances of the case, this Court is of the view that it is not a fit case to grant anticipatory bail to the petitioner herein.
