THE HONOURABLE SRI JUSTICE C.PRAVEEN KUMAR CIVIL REVISION PETITION No.3534 OF 2017 ORDER:

This Civil Revision Petition, under Section 151 of the Code of Civil Procedure, came to be filed assailing the order dated 16.06.2017 passed in E.P.No.59 of 2016 in O.S.No.106 of 2016 by the I Additional Junior Civil Judge, Tirupati, whereby and whereunder the E.P. filed by the respondent-decree holder for realization of the decretal amount was allowed ordering sale of petition schedule property by way of proclamation of sale by public auction.

Today, when the matter is taken up for hearing, the learned counsel for the petitioner-judgment debtor would submit that if six months time is granted, the petitioner is willing to pay the E.P. amount.

Conceding for the same, the learned counsel for the respondent would submit that in case the petitioner fails to pay the amount within the prescribed time, the respondent may be permitted to take suitable steps for execution of order passed in the E.P.

In view of the submissions made by both the counsel, the Civil Revision Petition is disposed of directing the petitioner to pay the decretal amount in instalments @ Rs.75,000/- per month, commencing from the month of October, 2017, to be paid on or before 15th of every month, to the credit of E.P.No.59/2016. On such deposit, the respondent is at liberty to withdraw the same. In default of payment of the amount by the petitioner within six

months, as agreed upon, the respondent is at liberty to take appropriate steps in accordance with the order passed in E.P. Consequently, miscellaneous petitions pending in this revision, if any, shall stand closed. No order as to costs. _____________________________ JUSTICE C. PRAVEEN KUMAR 15.09.2017 sur
